Owner of seized car to sue police

The doctor whose Lamborghini was falsely seized under hoon laws is likely to sue for more than $100,000 over electronic damage allegedly done to the sports car while it was impounded.


Dr Patrick Nugawela said yesterday he had no option but to sue WA Police, who seized his $200,000 car for 28 days because they alleged mechanic Leone Antonino Magistro, 53, of Mt Lawley drove it at 160kmh on Reid Highway in January last year.

Mr Magistro was cleared in November of reckless driving, with a magistrate ruling that the police pursuing him had been travelling too far behind to measure the car's speed accurately.

Dr Nugawela said the radio, DVD, GPS, telephone, reversing video, air-conditioning and engine management computer did not work when he got it back in February last year. He had to send it to Melbourne to be fixed at a cost of $50,000 and was without the car for four months. He claimed the problems with the car would taint it in the eyes of prospective buyers and had reduced its value.

The size of his claim against the police was likely to exceed $100,000 based on the cost of the repairs, inconvenience and depreciation.
